Family Law:  We have a diverse and wide-ranging clientele in Family Law matters.  We regularly represent clients in prenuptial agreements, post-nuptial agreements, paternity cases, marital dissolution cases, custody, child support, spousal support and post-dissolution modifications, legal separations, and cohabitation agreements.  Here are some of the Family Law related cases we have handled:

  • Dissolution of Marriage -- A proceeding to terminate the marriage and restore the parties to the status of unmarried persons.
      
  • Child Custody/Visitation Rights -- The issue of who will have legal and physical custody of a minor child and how the visitation plan will be shared generally comes up in the context of a party's paternity action, dissolution action, and post-dissolution of marriage matters.
      
  • Child Support -- The legal obligation of parents to contribute to the economic maintenance of their [generally minor] children.   
       
  • Prenuptial Agreements -- An agreement entered into by prospective spouses prior to marriage but in contemplation of marriage and inconsideration thereof, which can set property and other financial rights of one or both of the prospective spouses upon consummation of the marriage.
     
  • Post-nuptial Agreements -- An agreement after marriage between spouses still married to determine the rights of each in the other's property in the event of divorce or death.
     
  • Cohabitation Agreements -- An agreement among "non-marital partners" that fixes their economic affairs as they choose.
     
  • Legal Separation -- An option for those parties who wish to remain legally married, whether for religious or personal reasons such as maintenance of medical insurance benefits, however they wish to separate their lives just as formally and fully as parties to a dissolution of marriage.
      
  • Nullity of Marriage -- An action which seeks to declare the marriage null and void. 
     
  • Paternity -- A court action to determine whether a person is the father of a child born out of wedlock for the purpose of establishing custodial and support rights.
     
  • Spousal Support -- Monies awarded from one spouse to another to provide for the supported spouses' maintenance.
     
  • Post-Dissolution Matters -- Frequently orders made in Family Law Matters may be modified in subsequent proceedings.  Typically the following orders may be modified, while the legal requirements for obtaining a modification are different for each type of order:  Spousal Support, Child Support, and Child Custody and Visitation.
  • Domestic Partnership -- Many non-marital cohabitants may register as "domestic Partners" which is defined as "two adults who have chosen to share on anothers lives an intimate and committed relationship of mutual caring."
